ABOUT DANIEL EBADY

​​Daniel started his legal career at a litigation firm, where he practised mainly in the areas of corporate, commercial, construction, employment and other areas. He learned that most disputes can be resolved fairly early in the process.

​Equipped with business and litigation experience, he added to his arsenal, commercial and corporate law experience on the solicitor side. Advising (government) public-sector entities on their procurement obligations with a specific focus on ensuring compliance with domestic and international trade agreements. Also advising middle market to larger businesses as corporate counsel. ​​

 

He has become the go-to lawyer for businesses and professionals on all commercial and corporate matters such as contract drafting, advice, negotiation and steering transactions.  ​When a client is involved in a dispute, Daniel focuses on settling the dispute efficiently. However, if necessary, he will zealously litigate and advocate strongly for his clients to the fullest extent of the law.

 

​Daniel appears regularly before the Superior Court of Justice, appellate courts such as the Divisional Court and the Court of Appeal and various tribunals.  He has also assisted on cases that were before the Supreme Court of Canada. He is trial counsel and is regularly sought by outside firms to assist or take carriage of complex files.

  • Came on as second counsel on multiple year long shareholder dispute. Obtained favourable settlement for client. 

  • Successful on a heavily contested Summary Judgment Motion on a Mortgage Enforcement matter. 

 

  • Settled Construction lien matter before litigation commenced at almost 100% recovery

  • Successful at discharging Construction Lien and settled costs in favour of client based on passing of statutory limitation period.

  • Settled shareholder disputes after many years of litigation. Settled the matter within months of coming on the file.

  • Settled residential property dispute in favour of purchaser who could not close for pennies on the dollar. 

  • Settled franchise dispute early on in favour of client based on misrepresentation lease term in the APS.

  • Successful in resolving a two-year long motion to discharge a CPL on favourable terms (coming on as 3rd counsel on the file).

  • Settled 7 year condominium dispute (as second counsel)

  • Resisted Oppression Application seeking to force a sale.

  • Reduced Private lenders fees significantly on a summary judgment motion.

  • Conducted Trial at Superior Court on Dispute on Sales Agents’ commission.

  • Stopped power of sale proceeding after judgment and eviction was obtained for the vendor to sell property.

  • Settled construction lien in favour of owner at pennies on the dollar.

  • Successfully defended commercial landlord facing an injunction motion by tenant.

  • Stopped a commercial landlord from terminating and evicting commercial tenant.
